We act on behalf of Tony Margiotta.
We can confirm issuing Plenary Summons on Tuesday 30/9/25 for damages including Aggravated and/or exemplary and/or punitive damages
We say our client was treated outrageously by the gardai when arrested and prosecuted for allegedly preparing falsified sick notes in June 2017.
The case was later thrown out. He ought to be enjoying the status of an entirely innocent man but that’s been taken from him following the vindictive knee jerk decision by gardai to file a complaint with Dr Margiotta’s professional body.
For over 6 years now he’s had to bear the oppression of a Medical Council Inquiry hanging over his head like a sword of Damocles.
It’s against this background we have no hesitation endorsing an action in damages against AGS for:
- Malicious prosecution;
- False and Wrongful Imprisonment;
- Trespass to the Person;
- Misuse of Process;
- Infringement of the Plaintiff’s constitutional right to bodily integrity and privacy;
- Intentional and/or reckless and/or negligent infliction of emotional harm and or economic loss;
- Negligence and breach of duty including breach of statutory duty of the Defendants, their servants and agents;
- Conspiracy, unlawful means conspiracy;
- Misfeasance in public office;
- Stigma damage and/or injurious falsehood;
- Intimidation;
- Mental Distress;
- All loss, damage, inconvenience and expenses caused or occasioned as a result of the civil wrongs and each of them recited above;
His case chimes with that of his sister Lynn Margiotta who was similarly prosecuted for something she didn’t do.
