APPEAL BY DENNIS HUTCHINGS AGAINST PROSECUTION FOR MURDER OF J P CUNNINGHAM BEING HERD BEFORE UK SUPREME COURT

KRW LAW LLP is instructed on behalf of the family of John Patrick Cunningham. John Patrick Cunningham (27) was shot by the British Army on 15thJune 1974 at Carrickness, Benburb, Northern Ireland  at the height of the Conflict.

 

Dennis Hutching was a serving soldier with the Life Guards Regiment. Two charges of attempted murder and attempted grievous bodily harm with intent were bought against him in 2015 relating to the death of J P Cunningham .

 

The proceedings are stayed before the Crown Court in Belfast as Mr Hutchings – who contests his prosecution – challenges the decision of the Decision of the Public Prosecutions for Northern Ireland to have Mr Hutchings face trial before a judge sitting without a jury.

 

The Northern Ireland High Court dismissed Mr Hutching’s appeal in 2017. Mr Hutching’s now appeal to the UK Supreme Court. The hearing is being heard today in London. Judgment will be reserved.

 

The hearing coincides with the awaited decision of the Director of the Public Prosecutions relating to the  prosecution of soldiers involved in The Bloody Sunday killings in 1972.
